WASHINGTON (AP) — The Supreme Court ruled Tuesday that police may search a home without a warrant when two occupants disagree about allowing officers to enter, and the resident who refuses access is then arrested.

The justices declined to extend an earlier ruling denying entry to police when the occupants disagree and both are present.

Justice Samuel Alito wrote the court's 6-3 decision holding that an occupant may not object to a search when he is not at home.

"We therefore hold that an occupant who is absent due to a lawful detention or arrest stands in the same shoes as an occupant who is absent for any other reason," Alito said.

It is a simple legal question. It is not conservative vs liberal. If the cops knock on the door while you are at work, and your wife allows them in, can you sue them for illegal search saying you would not have allowed it? Of course in this case the guy was there the 1st time, but then he was absent the 2nd time, and the wife let them in.

Why do people like you constantly revert to juvenile name calling just because people don't share your opinions?

If you can't defend your position WITHOUT the name calling, you don't have much of a case.

This is similar to the argument Obama uses in justifying the killing of American citizens without due process and it's wrong. Someone might be able to come up with different scenario's but I am discussing this one.

He's in police custody. The police are there surrounding the premises. It wouldn't take but a short time to get a judge to issue a warrant.

When Obama killed Anwar al-Awlaki he had been targeted for months and they had plenty of time to have tried him during that period. Perhaps there might be scenario's in the future not as clear and easy as these two cases but when it's actually easier to grant people their rights, there is no excuse for not doing it.

That's completely different. You did not deny them the right to enter your home. No, the police do not have to undergo a separate investigation to determine every single residents of a home, track them all down and ask them individually. In this case they were specifically told no by one of the homeowners.

As I note above it's so stupid to simply not do it the right way. A judge would have issued the warrant in a manner of minutes. With todays technology they likely could have had it at the scene in hardly no time.

The OP seems to REALLY want to blame conservatives for this ruling. But the case originated in California, a state totally run by liberals.

Does the OP credit conservatives for other Supreme Court rulings that prevented law enforcement from attaching a GPS tracking device to your car without a search warrant?
