He did though. His Admin acknowledged that and "apologized" while using the silly "medical/health" excuse. Carney even said they would notify Congress as the law states a while back before they'd ever do something like this.
And let's not forget the lies they just spewed about this guy serving honorably when all the evidence we have shows he was a deserter.

Show me the law. There is no law for the president to unilaterally release an enemy combatant. If you don't believe the white house lawyers are ready for questions, you're wrong.
Oh, the "30 day law"? Is that what you're thinking.
They were informed this may happen in 2011, 2012, and 2013.
Then the president did it. No where in the law does it say congress had to approve.

Not according to Democrat Sen. Feinstein.
"Democratic Sen. Dianne Feinstein and Republican Sen. Saxby Chambliss said the administration violated the law by failing to address serious concerns they had about the deal to swap Bergdahl for five Taliban detainees.
..."It comes to us with some surprise and dismay that the transfers went ahead with no consultation, totally not following law," Feinstein told reporters following a closed door meeting. "And in an issue with this kind of concern to a committee that bears the oversight responsibility, I think you can see that we're very dismayed about it ."
Both also said they do not believe the soldier’s health was a factor in the decision."

And I've noted all through this thread they didn't have to approve. Obama isn't even making up the excuses you are.
The question I have is, if the Pentagon knew he was a deserter, I believe he is and they did know based on
reports from those who served with him, how did he get promote from Pfc. to Sgt. while being a deserter and away from duty?
