I admit to not knowing how an undeclared war can be declared over when we'll have troops in Afghan for 2 years after the war is declared over, but...
releasing the 5 now instead of December means they have 6 more months to return to the fight while U.S. troops are there.

A generalization that means nothing. If there is proof a trial is simply just a formality but one that allows us to not be them.
Even Saddam got a trial.
