your own posting actually validates the other posters point.

The constitution is strong enough to survive change, but since its not changing, its not a living document. Only upon a change in the constitution can you then claim its breathing again.

And since you have to admit the Constitution isnt changing, but in realty our legal system and political system is, moving towards a greater and greater police state, you then have to admit the premace of the thread.

While I admit its not really "no longer in effect", to deny the government uses it to subvert the intent, which was to actually protect us from them is ridiculous.

Law enforcement is selective, and punishments arent consistant across the board.

There is no equalizer taking place in the courts

Open your eyes. Look at the decisions being handed down by the Supreme Court and lower federal courts, and you will see the workings of the Constitution. It is very much alive and well.

Thats only if you have the funds to take cases to the Supreme Court meaning those of us with means have to lead the way for those who dont. And if we dont share the same concerns, then they can sit in jail until whenever..

I guess that seems fair to you

Valid point, and to add, when we replaced the Senate with elected officials from the public, and not the states, this gave the federal government far more power over the states because the states lost their balance.

What planet are you living on. The entire justice system in the united states is hopelessly corrupted because it is a `Political` justice system and not a legal justice system. We know its a given that politicians are dishonest liars who can not be trusted. So the USA in its great wisdom makes almost all the important players in the justice system POLITICIANS. DAs, sheriffs, judges are all elected and must become politicians with all the corrupted baggage that comes along with that. They depend on $$$$$$ to attain their positions and keep their positions. The pursuit of justice become a secondary consideration and in many case an actual impediment to the maintaining of their positions.
