I have often wondered what the authority of BP agents is. Those of you who don't live near the border may not be aware that there are checkpoints along the highways and freeways where the BP stops all cars and "takes a look". If they smell booze and suspect DUI, apparently they have no duty or authority to arrest if (and it's a big if given the source) the article is to be believed. On the other hand, there are usually local cops at the checkpoints so I suppose they might just point you out.
Crazy! Bartenders are liable if they serve drunk people because the person might drive somewhere and hurt someone. But federal agents who know someone is drunk are supposed to ignore it? So your local bartender has more liability than trained federal agents.

Hey, I don't like the idea of them putting impaired drivers back out on the road, but every law enforcement agency has limits to their jurisdiction. Does the border patrol have the training and equipment (ie breathalyzers) to administer sobriety tests? Is that what we want our Border Patrol agents using their time and resources on?
Like I said, I don't like the idea of putting impaired drivers back on the road, and it seems like they could easily detain suspects and call on local law enforcement to take it from there, but there may be many factors that I'm not thinking of/not aware of that could complicate or even nullify such detentions.
That is all we need now, NOT. Besides those who text and talk while driving, now add this to the mix. Guess there are limits to everything. But I sure as hell do not like the idea of impaired drunk drivers, being put back on the road again.
