but being trained by the military to kill, I choose a different route
the robber will be short 2 kneecaps and two shoulders when I am done with him...he can have a glorious time of pain in jail
Uh; you'd be better to off a perp IMHO. Otherwise some whackadoodle lawyer MAY try to sue you; even tho you'd probably win the case, it'd still be a pain.
Might be wise to avoid a confrontation. Stay in a bedroom or safe room if feasible. If you have children or family members in other rooms you may need to go out and make sure they're safe. Otherwise, stay put and call 911. If you have a firearm be prepared to use it. In any event, be 100% sure of you're target before shooting.
That has always been my plan if, as you say, it's feasible.
Lock myself in a room, call 911. If the intruder tries to enter that room, shout out a warning that I am armed and will shoot them. Then shoot them if they enter the room before the police arrive.
A neighborhood 6 year old walking into your home, through an unlocked door, in broad daylight, maybe.....hardly a situation where a homeowner would shoot.
A 6 year old getting past locked doors in the middle of the night, I am willing to bet that has never happened.
The argument is that the maximum legal penalty for breaking and entering is not death. The home owner would still have self defense as a cause, but self defense requires that a reasonable person would be in fear for their life or the life of their loved ones.
Let's create a hypothetical. Your neighbor, whom you hate, gets drunk and when returning home walks into your house by mistake. You get out of bed, arm yourself and walk into your living room. You find your neighbor peacefully sleeping on your couch. With the light on you recognize him and decide this is your chance to get rid of him. The Castle Doctrine allows you to kill him. Does that seem right?
If we legislated by one in a billion chance scenarios, can you imagine how messed up this country would be?
