The 4th circuit court of appeals has struke down a Maryland ban of assault weapons and magazines that hold more than 10 rounds. Basically citing the heller ruining protecting arms in common usage. They also ruled that the 2nd amendment should be interpreted using stick scrutiny (which is huge). This creates conflict in the districts increasing the likelihood scotus will take this case on appeal (which will most likely be appealed).

This is good news, this creates a conflict in the Circuits which generally compels SCOTUS to hear the issue. Their recent denial of cert in an assault weapons ban case comes to mind.

Why would this get appealed? O'Malley was a far left liberal governor. Maryland currently has a republican administration. The losing party has standing; I don't see the current Maryland governor wasting the state's dwindling supply of money on an appeal here.

(Last I heard he was still trying to cover the $125 million that got wasted on a healthcare sign up thing that didn't work...)

Generally it is the AG of a state that determines an appeal.

Not sure how MD politics work, but are the AG and Gov both R's? My guess is they are not. But it will be interesting to see if there is a spitting contest between the two.
