Federal judge blocks expansion of Obama's overtime pay rule

A federal judge on Tuesday blocked an Obama administration rule to extend mandatory overtime pay to more than 4 million workers from taking effect, imperiling one of the outgoing president's signature achievements for boosting wages.

Mazzant, who was appointed by President Obama, held that the rule runs counter to the federal law that governs who is eligible for overtime. The law does not allow the Labor Department to determine eligibility based only on salary levels, Mazzant said.


Good for small businesses that they do not have to make some tough choices regarding their employees as described in the OP.

Everyone is missing the whole point of why this was passed in the first place. Employers don't like paying overtime, so if they don't have to, they have as few employees as possible, making them all work maybe 10+ hrs per day. If forced to pay overtime, then they might hire a couple of extra workers rather than pay the overtime. Add this up for thousands of businesses around the country and boom, lower unemployement

Its a huge scandal that not every worker in America gets overtime pay. But thats what we get when we allow the ruling donor class to buy our politicians.

Time to get big money out of politics and end this scandal. Join up with www.represent.us to fight back against the special interests and lobbyists.

Also, retail takes advantage of the overtime law. There's a big loop hole which is probably there on purpose by manipulating the work week into having employees work 6-10 days in a row without any overtime at all. They simply switch employees days off so a work week butts up against another thus the employee still works 40 hours in one work week but ends up working 6-10 days in a row without a day off and no overtime.

For example the work week begins on Saturday and ends on Friday
Week one - The employee has Sat and Sun off
Week two - The employee has Thursday and Friday off

The employee is working Monday all the way through until the end of the next week working 10 days straight with no overtime but the hours are legally in two different work weeks. This is done all the time so employees have to work 6-10 days in a row with no overtime.

no - they never had it. It was supposed to begin Dec. 1.

You guys have to understand that not all companies have piles of cash laying around to pay employees overtime.... and most likely employee benefits will be the casualty - if they still have their job.

Then they should hire more people instead of stealing unpaid labor from workers! But wage theft is fine as long as the rich get richer of course. Thats the agenda of this Trump administration. To hell with the working class.
