I absolutely agree that the focus ought to be on the behavior, which is why we don't need the equivalent of fashion police in the first place. "Purposes of concealment" would be fine so long as a charge stemming from such language would only be applied once the commission of a crime had taken place, otherwise a preemptive arrest would presume that law enforcement and/or other agents of the government had mind-reading abilities.

If it's that cold, people should stay inside.
If protesting, no costumes/masks allowed; otherwise dress as you like as you mingle and celebrate holidays.
In areas of recreation -- do you mean such as rioting on a ski slope?
Impromptu protests - there's no time to prepare with donning of masks if it's truly impromptu.
As someone said, we have enough regulation. Rioters should be arrested, not tolerated. Period.

I appreciate the humor and agree wholeheartedly with the bold.
In any case, was just trying to compile a list of everything I imagined other posters might suggest so as to keep the thread as short as possible. I sympathize with the sentiment of the OP's post, but it's a nonstarter insofar as practical application is concerned without some very clever wording and extremely narrow application. Just isn't worth it imo.
