I think the shooter was acting out of anger, rather than fear -not that it would change anything, as both are justifiable responses.

The most shocking part of this story is that a man would blind side push an older gentleman in front of his own kids.

Did it ever occur to the parents not to break the law (illegal parking, assault) in front of their own kids? What did they think was going to happen? Beat up an older man then carry on about your day?

The deceased died in a gas station, a predictable ending to short tempered bullies who are quick to assault people without thinking.

I mean, he was only 47.

That probably exacerbated the downed man's already pre-angered mind.

The killer obviously shot and killed in anger.
Why do you feel he reacted out of anger, rather than fear?

I think I know why, but I'd like to hear your take.

And the deceased was only 28..

Do you have any idea what type of advantage that is? How many people 19+ years older than you have you assaulted?

Someone who confronts people over issues such as handicapped parks, gets into (alleged) threatening quarrels, and walks around armed, isn't that likely to be someone who instantly gets fearful when faced with a physical assault.... imo.

Guns talk without firing.

There is visible evidence that everyone backed away when he pulled his gun.
If you start and stop the video and watch the time display on your computer's video player, you will see that that happened within the same second.

If it goes to trial, I imagine each side will bring in experts. One side of experts will say that that was enough time to stop, and the other side will say it is not. Experts on each side will likely present evidence. Then a jury will interpret which experts appear most credible.

Yeah, silly him for not thinking a 28 year old male would blind side assault him when he woke up that morning.

Just saying I don't think he acted out of fear - from what has been said on here about him, he wasn't the shrinking violet type.

Pretty sure my dad could probably still kick my ass. It would be close though.

28 to 47 isn't quite like 47 to 66, or 66 to 85. Both men should still be in reasonable shape at that point. If he had some underlying condition, then maybe thats different, but its one guy in his prime, and one guy barely out of it. Don't act like he beat up an old man.

For the record, I've never assaulted anyone, but the carnage left over after my wife's peach cobbler last night may come close to criminal.
