If I were the judge I would sentence Flynn to the max and suspend its implementation pending cooperation with Mueller. There needs to be a hammer available.
Apparently Michael Flynn is being TORCHED by a federal judge right now, as I type this.
Disgraced General Michael Flynn flipped on Donald Trump and provided "substantial assistance" in the Mueller investigation. With that said, federal prosecutors were going to recommend little to no jail time at all for Michael Flynn today.
We shall see what happens with Flynn's sentencing.

The judge walked back everything he said about Flynn.
The judge said he misspoke, and corrected himself. The Judge said Flynn was not working as a foreign agent while working for the Trump Administration. A complete walk back of his earlier comment.
The judge also clarified his statement about treason. The judge made it clear that he was not saying Flynn committed treason, he was asking the Mueller team if they thought Flynn committed treason. The Mueller team said that Flynn did not committed treason.

I agree that from a statutory standpoint Flynn did not commit treason. The problem is that everything that quacks like a duck isn't a duck, but I feel that many who look at his behavior feel that he walked up to the edge. The plot to kidnap a US resident to render him to a foreign power stinks.
We don't know what Mueller knows and the Judge's thoughts doubtless complicate deals he may want to make with other informants.
Flynn's attornies claim that he was duped by the FBI didn't endear him to the Judge. I think it was intended to give Trump some cover but it as a bad strategic moved for their client.
I suspect that Mueller has other charges against Flynn in his back pocket in case Trump decides to pardon him.

The judge was smart to hold off on the sentence until all cooperation is complete. Flynn has the judge's wrath or misery hanging over his head. Lock him up is back to haunt Flynn.
