3. NDA's are all but unenforceable in many circumstances. It is my belief that they are required of all employees at some companies because their legal advisors feel that makes it more enforceable against the "big cheeses" (pun intended) whom it's aimed at.

The videos with his manager at least imply that the manager knows and promotes the activity
if there is something there, then why didnt the guy take a copy of the video to the health department and have them investigate the issue, or take a copy to the local news outlet and have them investigate? he violated the NDA, and the rules of the business, and he was fired properly. remember the rule was no cell phones in the business carried by the employees. that is part of the NDA that is enforceable, since it is not against public interest.

Who knows, maybe he did file a complaint with the health department. The inspector can go out there & do a complaint investigation but if the inspector sees no wrong doing while they are there, they cannot write up any violations.
