Again, not the way it works. They weren’t waiting the 12 days for ICE to come along. They had him in jail for 12 days for their own purposes. They weren’t supposed to pick him up until the local authorities notified them that they were done with him. The local authorities kept him as long as they wanted to keep him, at which point they were supposed to notify ICE that they were to be released, so ICE could come and pick them up. ICE does not have the authority to remove them from the custody of the local authorities for crimes they committed locally.

The detainer asked that they notify ICE before they release the prisoner, so they could take custody, but the local authorities never notified ICE. They just released him into the community.

The local government in these cases is not done with the individuals until such time a jury or judge reaches a decision on their fate. So when the individuals were freed they were still bound to the local judicial system.

It is an interesting problem. Turn them over to ICE and they vanish back into Mexico often in a few weeks or less. That removes them from the potential for long term prison they may have deserved. So should they be punished for their crimes or allowed to escape out of the country with the help of the Feds?

It is a tough situation, because I cant think of too many bigger flight risks than illegal aliens who are used to living under the radar already. What amazes me most is that a judge would allow such a flight risk, who is arrested for raping a child, to post bail.

I too find that the most interesting thing. It may indicate however that the cases involved are not overpowering and the presumption of innocence is at work. It would however seem that the cases should run their courses before the Feds get involved. I would presume the courts have reason to believe that the bail is sufficient to make the appearance very likely. If not there is clearly a problem that has nothing to do with immigration status.

And was there anything that precluded ICE from getting a warrant signed by a judge? Every jail in the US would have honored that.

For them to foresee the need to do that, they would have had to assume the detainer would not be honored. Given the nature of the crime, they likely didn’t assume that. But who knows? The article didn't go into that.

I'm pretty sure that they knew the policy of the local jail, it's hardly a secret. I'm just gobsmacked that after all the problems with ICE detainers they still refuse to get a judicial warrant, they can be obtained electronically, the only time they would have a problem obtaining one is if they lack probable cause...

You know better than that. They do not have the needed evidence to get a warrant. They have a suspicion but not any real evidence. They hold people and then try and determine if they are illegal.
