The OP might also have mentioned that the DC Circuit order is more akin to a stay that a ruling. It gives the so-called government a chance to present arguments that the Circuit Court should hear its appeal of a lower court ruling that denied the power to indefinitely detain people against whom neither a case nor any charges have been brought or (in this case) will be brought. The actual merits underlying that lower court ruling have not yet been touched.
I would think that Barrack Obama will have these poor guys released when he is sworn in as President and will see to it that many other innocent political prisoners will be released. Don't you think?

I would expect to see Gitmo shut down in fairly short order with some actual process employed in resolving the status of those currently detained there. If there are legitimate cases to be brought, then bring them. If not, then repatriate them. If no country will take them, put them through the Witness Protection Program and set them all up with new identities in Crawford, Texas...
