A Northern California family is expected to be torn apart on Friday when Shirley Tan is scheduled to be deported back to the Philippines, leaving behind her life partner and their 12 year old twin sons.
Tan and Jaylynn “Jay” Mercado were married in San Francisco in 2004. Their marriage was voided, but even if it still were in effect the federal Defense of Marriage Act prevents Mercado from sponsoring her partner of 23 years for immigration. Were the women a married opposite-sex couple, Tan could be legal.

she is an illegal immigrant, she was here illegally. she would need to marry outside of the United States and then petition for entry. she isn't being booted out for her sexual preferance she is being deported for breaking the law.
First of all, I think you know what my views on gay marriage are --- I fully support it.
But c'mon! This article was Less journalism and more propaganda. Where is the information on how long Tan was in the country? Has she been here 23 years? How did she enter the country originally? Why in all those presumably 23 years has she not attempted to rectify her immigration status? 23 years is a loooooong time to let a tourist visa slide, for gods sake.
If proponents for gay marriage are looking for a poster couple, they should keep looking. This couple are either chronically stupid and/or lazy. No reason on Earth to go 23 years without either becoming a citizen or at least a legal immigrant.

I can't believe I just repped someone who supports gay marriage, but there you have it!
If she was a heterosexual woman and getting married to a male, she would already be a citizen.
Americans in same-sex relationships cannot sponsor their partners for legal residency.
The article doesn't say much about her immigration, but it's possible that if she had not been here illegally then they would have never met. Again, the article doesn't give us that information because it's irrelevant to the agenda of the author.
