By definition, racism only occurs if someone implies, or states, that their race makes them superior to another's race. Just like a man feeling he is better than a woman because of his gender is sexism. To say that a minority woman might serve the courts well because of her diversity, is a far cry from saying she is better solely by virtue of being Hispanic and not some other race. So, is she still racist?

I thought the responsibility of making policy was left in the hands of legislature? I would think the appeals courts judge cases on law and not opinion.

Racist being used as a very liberal term because many Hispanics, not saying her specifically, but many believe that they are a different race and that their blood is superior.
