WASHINGTON -- In a victory for former Secretary of Defense Donald Rumsfeld and 10 high-ranking military officers, the Supreme Court announced Monday it will not hear an appeal brought by four former Guantanamo Bay detainees who claim they were tortured and were trying to sue the people they blame for their alleged mistreatment.

Solicitor General Elena Kagan refused to concede the torture allegations and defended the lower court's immunity analysis. Furthermore, Kagan says "it was not clearly established at the time (the plaintiffs) were detained at Guantanamo Bay that they had the constitutional rights they claim were violated."

I agree, they should not have ANY constitutional rights at all.

Guess those libs who were after Bush after Bush just got a big ole smackdown.

Any one who would want to give them rights cannot be real Americans.

Besides enemy combatants/terrorist have no rights under the Geneva Conv to begin with.

The dog and pony show in NYC will show us who is for America and who is against America.

I find it rather unappealing for people to place terrorists in neither the POW nor the constitutional right camp. It really is no different than when Hitler jailed political dissidents & Jews with no trial and regular beat downs. No civilized society would stand for such treatment of prisoners.

Yeah, but the idea here isn't to hold them until they die before they see some sort of court room. It might seem that way, and I personally dont care how long they wait. The whole reason the "terrorist" label was removed was so they could escape certain things and have to be pushed through our civilian system which will take forever and ever.

Those guys have been going on about this for years. They should know better by now: Rummy has immunity. He can torture anyone he wants.

Taking away your personal property may be ok with many others in this country, but that doesn't mean it should be done.

Aint no way the "law" is going to side against elderly white males with over 30 years experience in U.S. government and it does not matter what evidence is produced. There is no telling how many people have been murdered in U.S. custody but we know thousands have been tortured.

There is one university that has used the FOIA to determine that three detainees in GITMO that were called "suicides" all had rags shoved down their throats prior to their deaths. One of the three had a release date scheduled in a few months.

Beheading someone because they are an American is not as important as worrying if you have rights or not. Wonder if Daniel Pearl was asked if it is ok to film him first being murdered.

There are two camps in this debate:

Camp A: Believes in the transparency of United States law and believes that everyone is determined to basic rights and liberties, regardless of the color of their skin or their religion.

Camp B: This camp has always wanted something closer to what existed in Nazi Germany than anything that has existed over the past 200 years in this country. They are paranoid, often schizo as well, and think subjugation is the answer to any problems.
