this is the second time we're having to deal with this. it first happened in June 2006. we had a layer of red clay on top of our established yard ranging from 1/4 to 3/4 in thick from mud runoff from the vacant land behind us. after about 3 months of going round n round with the town and builder about who was responsible it was decided that the developer was responsible, so they dug up our grass, re-seeded the yard and put some grass seed and hay on the lot behind us and added a silt fence. here we are 5 years later and it's happening again. I am going to call the DENR tomorrow, but am wondering who else I should call. we are fed up. we shouldn't have to go through this again. so fed up!

Tried wake county enviromental department?

We had a similar issue occur a few years back.

Tom Horstman (TOC) was a lot of help. We also contacted the Division of Water Quality. They are very strict about this sort of thing.

If you can't get anywhere with them, I would contact your local town council representative. When the TOC approves development plans, the developer is required to have certain temporary stormwater runoff plans in effect in order to prevent the type of situation that is occurring to your property.

If I recall correctly, the TOC threatened to fine the developer if they did not fix our yard and take care of the situation. It happened several times before the final drainage plans were in place. The developer fixed the damages to our yard within a few days.
