So we bought a home last June. Our property taxes are paid out of our escrow. I noticed my amount taken out of my account had not changed from my fall payment, but I knew it should be much lower because of our homestead and mortgage deductions this year. So I call up there and they tell me the house was still in the previous owners name..

I took all my paperwork which clearly shows the county records office should have filed it but apparently they didn't so they are correcting this issue "Supposedly". While I was there they told me my taxes were overdue, which my escrow is suppose to pay. The bank shows they paid it and everything is good. My question is what should I do? Lets say the county "finds" my payment and the deed is all corrected. I still overpaid on the taxes. How do I get that money back?

Sorry this has been a huge mess and its our first home we have ever bought. So we are kind of freaking out.

The auditor's office. They also called the recorders office to confirm. They said they will fix the deed.

Contact the bank and ask for details on the tax payment. Since the account was still in the previous owner's name, the check/wire may not have been credited to the correct account or it may have been returned. Do not do this over the phone, you may need a paper trail. Also, if the tax collector's office doesn't rectify the situation with the overdue costs, you may need proof that the responsibility for changing the name on the account lies with their office.

On the other hand, if the bank received their payment back and did nothing, this may be their error.

Your post is a little confusing to me as you are mentioning several things that involve different county offices in Indiana.

First, did you personally go to the Auditor's office AFTER you purchased the home to apply for your deductions? Title companies can now file for you for one of them, but not the other. Did you keep the paperwork? Auditor's offices have lost the paperwork in the past. Without it, you have no proof that you filed for the Homestead or Mortgage deduction.

Are you saying the Recorder's office never received the record of the new deed or your mortgage? Call the title company that did your closing. It should have been recorded and they should have proof of this.

Finally, tax payments go to the Treasurer's office. Did that office indicate the taxes were not paid? Given that they were just due, it may not be showing up in the records yet.

It's not likely you will receive a refund for any overpayment. What will happen is that it will be deducted from your second 1/2 year payment.

Our of curiosity, what county are you in?

Yes we did apply for the deduction and we do have the receipts. I took those to the auditors office.

The Recorders office did received the new deed. I have the proof but they fail to put it in the system.

Im in Knox county.

Well, that all is unfortunate for you. I'd be mad at the screw up by the Recorder's office, but there isn't much you can do except vote for others eventually.

I would recommend, if you've not done so, to get in touch with the Treasurer's office and confirm that it has not been paid. Before doing so get on the phone with your mortgage company escrow department and get them to email you something that indicates when the taxes were sent, to whom, etc. Have the proof of payment available. I wouldn't trust anything the Recorder tells you at this point.

The reason I suggested is that the most likely outcome is a reduction in your second tax payment is because that is what happened in Monroe County a few years ago. The Auditor's office lost records of Homestead and Mortgage deductions. If people didn't have proof they filed for the deduction it was lost. No one received refunds, but they received reductions in future payments. Unfortunately it might not even happen this year. It maybe a credit on your taxes next year. Mortgage companies are required to re-evaluate escrow yearly. They will issue a refund if it's more than a certain amount or reduce your monthly payment.

Sorry you're in this situation. We recently went through a similar escrow screw-up because our lender paid the wrong insurance company. It's going to take a few years to straighten it out.

I went my mortgage servicer they are checking into it. They have documentation from when they sent it. Hopefully I can get this mess sorted out. I figure if it could go wrong it would be me that it went wrong too.

Hello,

I am in Marion County. We failed to file our homestead credit verification form that should of been filed for the 2014 property tax year. In 2014 we paid triple the cost in property taxes and triple the taxes for our first semi-annual payment in 2015. We pay our property taxes through our escrow account through mortgage lender. We are going to file our verification form with the auditors office. Once that is complete, what will happen to our overpayment?

I'm not so familiar with such egregious mistakes on the part of bank or muni office. I have had experience with these kinds of things when a settlement agent/attorney held up funds because they were....well,utilizing them themselves or their car was found in the airport parking lot after they disappeared. Just reminds me of that kind of situation.

Have you contacted whoever did your settlement?
