Is it still in some places? It used to be very common here, but for about the last few decades, it is very uncommon except on rural property or property that has never been split since the original survey.

Even in my backwoods podunk county they don't allow that any more. It's actually not legal to do so in the entire state now, but we sure have a lot of lots that fit that description around.

Excess land is the land that could, if severed from the original tract, would have a separate highest and best use and could be developed. Mixed into this is the assumption that the severance is legal and meets the requirements for an independent developable site.

I recently reviewed a report where a 30,000 sf lot was valued at less than a 9,500 sf lot. The lot was in a subdivision of predominately 8-11,000 foot lots and the buyers for these tracts were not willing to buy a lot that required the extra maintenance without contributing to the livability of the property.
