The listing agreement is between the seller and the brokerage. The sales person is only a sub agent of the broker. My advice to is to speak to the broker who is listed on the contract and let him know what has transpired. I hope this will put an end to the agent's ridiculous threat.
Thousands of listings go into foreclosure every week. The listing agents aren't owed any commission in that sad eventuality.
A foreclosure is not a sale and your agent is being greedy. You're being bullied because the agent is assuming you know nothing of real estate laws and is hoping to make a profit on your lack of knowledge. It would make you feel better if you were to speak with another agent in your area and ask a hypothetical question regarding what would be owed to the agent, if the agent is unable to sell the home and you lose it to foreclosure.
I'm really sorry this is happening, the last thing you need when losing your house is a vulture trying to make a kill.
Although I'm not sure if this is covered by the code of ethics (it's more concerned with making sure REALTORS pay each other rather than actual ethics) that's not your problem to worry about. Get the paperwork started and make them prove it's not a violation. If nothing else it will waste the agent and broker's time.
Edited to add - file a complaint with the BBB as well. They're basically useless but again, it will waste a lot more of their time than it will yours. And see if the agent is reviewed on-line anywhere. Again, the goal isn't to get relief from these efforts but to show him it is going to be incredibly painful to continue this nonsense. Bonus points if he slips up and gives information that might be useful to you if it actually does go to court (which is extremely unlikely IMHO).
Yup, I'd pound this guy. Immediately file as many ethic complaints as you can. Talk to his broker (calmly.)
Also find a lawyer who will send off a letter to this loser while you are at it.
No way would this stand ! Wow...that is aweful. Pay a lawyer a few hundred bucks, get a letter and call it a day. If you're ever unhappy with your agent you can contact the agents office and ask for the broker in charge and let them know. If your agent is the broker, then contact the state licensing and labor commission, etc. And go on line and blog and post so much that whenever someone googles their name they will find your complaint!

Folks need to go into your settings and allow 40 posts per page. Your CD surfing of trolling posts and long threads will be MUCH more fulfilling.
Why would somebody allegedly smart enough to work in a job that affords him the ability to carry a $8500/mo mortgage, buy a house worth over 2 million if he relies on the whims of a boss for a paycheck? Or put enough thought into money management so to have a few bucks saved for a rainy day?
