Ok I lease an apartment and did not have to put down any security deposit.

I hate the apartment however, and we seem to be having problems one after another. My husband had to call the cops on management because they kept walking into my apartment without giving us notice and without our approval.

The hallways smell like dog urine, drugs are being used by neighbors so bad we can smell it in the hallways, and I dont want my daughter around this.

I have finally narrow down another complex, but now what would happen if I broke my lease here will they go back and charge me security or what?

Secondly I am now afraid they will try and come into my apartment once they know I am leaving and tried and charge me for damages. The carpet was filthy when I moved in the apartment, but I did do cleaning of all the carpets and final got them all clean.

Everything else I did work order requests to have the repaired after moving in and I had all repairs documented.

Also I still have copies of my walk through of the apartment in which they never did collect. So I took note of all damages on my copy signed it and drop a copy off at the lease office.

I also have in writing a pledge from them that if my job moved 30 miles from the apartment complex I could break my lease and pay a get ready charge of 250.00 - Since my job has relocated I figured I should be able to break the lease

Can they come back and try and make up the security deposit by charging me now?

Of course recovery can be attempted... either legit or otherwise. This is why we have a court system and small claims in particular.

Reading your post... I have to say some of your issues could and should have been easily avoided by not moving in.

Assessing physical condition of a property is part of due diligence and there is a penalty for not following through as you now find.

The $250 conditional cancellation policy sounds like your ace in hole should you need to defend yourself.

As far as the damages... damages caused during your tenancy will be expected to be repaired or payed for.

Normal wear and tear and pre-existing conditions are not your problem.

People think that "NO" sec. deposit is heaven...but if it sounds too good to be true it usually is...there is a reason for "NO" sec. deposit and you have now find out what it is.

Having said this, you have a signed copy of what how the place was on the day you moved which can be in your advantage but on the other hand it hasn't been signed by the management and in order to work really in your advantage that would have been better.

Staying there is probable not an option and a good idea and it is better to limit your damages and move out a.s.a.p. and do it the right way, otherwise you end up with a judgment against you.
