Thank you everyone. We did contact a lawyer who concurred with all of the advice given on this forum. The lease was indeed null and void due to nonpayment. Thanks again!
As a young property manager I made a horrible mistake... I let a family move in on a Saturday when they signed over a cashiers check to me... Husband, wife and two kids ages 2 and 5.
They were from out of state and had a job lined up with all their possessions in a Ryder truck.
Deposited the check first thing Monday morning and 3 days later the bank called and said it was bogus...
Never collected a single dime from the family and they lived there rent free for 5 weeks... that's how long it took to get them out.
Lesson learned...
No matter how good something appears... I just can't risk it because the stakes are too high to rush things... Back then, I had to call to check credit and it could not be done after hours or on a weekend.
