Just in case anyone is interested (probably not) I didn't bother pursuing this any further. As I posted originally I can totally see where he is coming from. It's his home, and in my opinion should be able to rent to whomever he wants. I was just purely curious whether this fell under the fair housing guidelines. Even if it was illegal, I had no intentions of pursuing anything because it's just not worth it to me, as there are tons of rentals available. However he did call me back the next day and claimed that he would be moving in sooner than a year and decided not to rent it. I didn't believe him, but still thanked him for at least calling me back.
Just to add. State rules can be even stricter than the Fed laws. For instance, in NJ a landlord cannot discriminate against people with children unless the property is OWNER occupied, or approved by the state to be a 55+ community. So a landlord may only have 1 house to rent, but unless it's a duplex and they live in the other half they can't discriminate.
When dealing with possible discrimination you have to look at both the Fed and state laws together.
I have been in my current apartment 5 years and paying $1680 (which is horrible) I have had a lot of complaints in the past 6-8 months about this place and they just raised the rent to $1748. The new listings for these apartments is $1612. There have been some things happening in the last few months that make me think they are trying to get rid of me. I am 56 years old and I now feel that they are discriminating me because of my age.

No, they’re not. But here’s the best part, you have the option of moving and finding something more suitable.
Raising rent is normal and to be exoexted. Why don’t you talk to your landlord and try to negotiate a lower rate? The worse they will say is no.
