You have every right to ask for documents proving their identity. Would you rent a place to someone if you don't know their name? Absolutely not. I get the feeling this "attorney" was just one of their buddies trying to get you to back off. You have a right to know the full name of everyone staying in your property.

What exactly do you need help on? If you file eviction papers against them in court you file against them in the name they have given you and will have the papers served accordingly. Whether they're legal or illegal immigrants is irrelevant. No reputable attorney would telephone you but would contact you in writing.

Follow through with the eviction, if you do not know how to do this, hire an attorney.

How did you find out that they are illegal?
When you originally got all their information over a year ago, did they give you fake documents? If so, I would think you could evict on the grounds that they lied on their application/information.

As others have said, you absolutely have the right to know the full names of everyone living in your property. I agree that this may not have been a real lawyer. Sounds like it's time for you to look up local eviction attorneys and get the ball rolling on starting the eviction process.

It makes no difference whether they are legal or not. You evict exactly the same way. You put the name of whatever tenant you know and then add "and all others". That covers everyone living there whether you know their name or not.

I think the advice to hire an eviction specialist attorney is good. It's easy enough to find out who is doing all the evictions in the area. If you use a specialist, it isn't expensive because they assembly line the evictions.

If it is a lease option, you are going to have more problems. Depending upon how the paperwork is worded, they might own an interest in the property and then you must foreclose. I sure hope you had a good lawyer draw up the lease option documents.

I have a quick question kind of on the same subject.

My good friend got told by his landlord he has to move out of his "closet sized" "Garage Guest House"
The unit is most likely being used illegally as it is, but they had no contracts everything verbal.

He was told last night he has by saturday to move out because his sister wants to use the space.

Does my friend have any rights? he is also here illegally...

It's irrelevant that your friend is an illegal immigrant. He's legally on a month to month agreement and his LL has to give him 30 days notice - or whatever the particular state's law decrees (you'll find that information linked in the first "sticky" on this page).

What happened to common sense and asking for an ID and running a background check?

When I started to rent out first I had to show my passport and visa prior to be able to rent...just normal procedure.

I guess the color of the money was more important at the time of them moving in so now you have to deal with the consequences.

That's odd. Apart from the obvious, I've NEVER had to show proof of citizenship for anything other than employment and never for renting. There are penalties for employers who hire illegal immigrants but not for landlords who rent to someone who's an illegal immigrant. There's absolutely no requirement for landlords to verify immigration status - in fact asking for documentation and then refusing a rental based on that would surely fall under the FHA discrimination banner ...

PS. Should add that there ARE penalties in the UK (in some cases) for renting to illegal immigrants but, again, there are (to the best of my knowledge) no laws in the USA covering this.
