I'm on month to month. i decided to move to a new apartment this weekend, everything is approved now. that was april 10th.
my current landlord says since i need to give 30 days so i have to rent my current apartment next month also. so in other words ill have my old place and new place for a month.
i know the answer is probably no, but any way around paying this? im guessing if i just move out without paying thats not good since they still have my security deposit anyways.
You're right - no. Leave the place spotless and before you return the keys have the LL do a walk-through with you to determine that you'll get your security deposit back. If the LL is able to re-rent the apartment before the next rental period he MAY return a portion of your last month's rent payment but he's not obligated to do so.
thanks that's what i figured. guess ill just have to eat the cost. id imagine she wont be in a rush to rerent since there are a few open apartments that havent been filled.
on the bright side i guess that gives me a whole month to move all my junk out.
I don't know your state but in California, the 30 day notice does not have to be on a month boundary. If you told him April 10th you wish to vacate, you are obligated to pay rent until May 9th.
when i asked the LL she said i had to do the full month. i asked about just paying half a month and she said no.
Probably best re-read your contract and determine the specific wordage as to whether it states 30 days or one month. If you do not have a copy of your rental agreement your landlord should furnish you one upon request. If not, request it in writing, certified mail. Start a paper trail if you intend to fight for your money.

it does say 30 days. guess i just have to chalk this one up to poor planning on my part

Why do people and you think that the security deposit has anything to do with the rent.

the "30 days" instead of "1 month" thing seems to indicate that you may have to only pay until May 9th according to what DowntownVentura said & could be a good find...
