I'd never live where there's an HOA. But it can't hurt for people who are unaware to know what they might be getting into.

OK, so now all the children under 18 must leave. There are still plenty of residents between 19 and 55 who will be living in a 55+ household. Somehow the rules don't make a lot of sense.

Over-55 communities with an HOA provide new residents with a copy of the HOA rules and the CCRs. These deed restrictions are filed with the state of Arizona and are enforceable. By purchasing a property in such a community, you accept the rules of the community.

I think that the residents have a legitimate beef with the management company if they do NOT enforce the rules of the community.

The problem is some people think they are "Special" and the rules do not apply to them.

What doesn't make sense? No children under 18 means no children under 18. What do residents between 19-54 have to do with it? 55+ communities have always allowed a certain portion of its residents to be between the ages of 19 and 54. Again, what does that have to do with the proscription against minor children living in the community?

Isn't it contradictory to allow ages other than 55+ in a 55+ community, unless the "underaged" is the spouse?

No more than 20% can be between age 19 to 54.

I recently toured a 55 and above apartment complex. The manager made a special point of telling me that by law no more than 20% of their residents can be 19 to 54. The manager told me that "at that time" out of the 130 or so current residents there was one woman in her late 20s living with and helping her grandparents and four residents who were in their early 50s. The manager told me that in that complex they never had more than 5% of the people between 19 and 54 and almost all of them ended up being people in their early 50s who wanted the "peace and quiet" of a 55 plus community or moved in with the anticipation that they would live there for many years.

I don't know how common that is but that seems pretty similar to where my in-laws lived and in the complexes where I have friends.

agree, that is the point of the post, for months the HOA which is still developer/builder controlled did nothing.
