I rented a room and held an $80 deposit. It was suppose to be rented out to a single occupant but there where always 2 people there so I gave a 30 days notice through text on the 11th for the tenant to leave because I felt cheated out of money charging a flat rate for utilities and at the rate I was giving for the room. He replied that he wanted to stay that the other person will no longer always be there. She continued to stay there but I said nothing about it. Then on the 14th I got notice through text that he will be moving out by the end of the month. He left without cleaning anything but he was out by the 1st.

Do I have the right to need a 30 day notice?
What rights do I have to use the $80 for rent and cleaning?

I remember sending a text with my expectations saying I need rent on the first every month ( i mentioned that the 2nd and 3rd where okay too) and I mentioned that I need 30 days notice. BUT!! I no longer have this text.

He is also claiming that the craigslist ad I posted stated 400 dollars. Not the case at all! I posted it saying 440. At this point he wants to take me to small claims court where he says I will also have to pay for his court fees?

wow, I hope you have all this in writing. Stop the texting and send a certified letter to him. If you have in writing only 1 person, that is all that should be in the room period.

I am not sure about small claims court but I think he is wrong. Call his bluff if you do have things documented.

I doubt he would go thru the work to sue for the return of $80
A deposit is just that - for unpaid rent and cleaning, send a certified letter stating so.
