You could very well lose in small claims. If you lived there just a year, say, it'll be hard to claim normal wear-and-tear. It is also hard to claim that $500 is unreasonable for replacing a carpet. Your best argument could be that they could have cleaned it, instead of replacing it, but you could still owe the cleaning cost ($250?). If not awarded your filing costs ($50?), that could mean you only come away with $200, but if taking off work...

They could also counter-sue you, asking for even more money.
Please take a look at stain here https://ibb.co/hTz3Fk and let me know if you feel the same.

The landord tenant act says reasonable wear and tear. This doesn't sound reasonable.

I feel the stain could have been gone by shampooing or stain removing. In worst case it could have been patched. But replacing carpet of complete apartment for this small stain seems unreasonable to me.

I have contacted apartment to suggest, I will be ready to take responsibility of cleaning the stain if they allow. However I am not willing to pay $500 got this stain.

However I also want to get idea from more experienced people like you. I appreciate your response.

Curry usually contains natural dyes which are near impossible to remove once dry without bleaching the carpet. Especially an old stain. Replacement may be the only fix.

$500 is not paying for carpet in the entire apartment...unless said apartment is a small studio.

True. Curry stains are very hard to get rid of. The fact they charged $180 for cleaning indicates they did try to clean it out, obviously without success. Patching the carpet isn't really worth the process.

My concern is that stains and wear are common and may be allowable under the statute to an extent.

Yes my apartment is a small Studio of area around 510 sq ft. Leave out bathroom, storage room, laundry room and kitchen area that does not have carpet.

So to clarify my previous badly phrased post- a stain could be reasonable wear and tear. Especially a small one. Why I put "not" in my post-i don't know. So please read the links and see. If you opt to go to small claims court, make sure you've read and can quote statute to support your argument-and maybe talk to a tenants rights organization.
