While it is a violation of the CP laws I doubt many DA's would go after teens for sexting. I know there were stories in the news about a DA prosecuting a few teens and there was a fair amount of backlash.
IMO, the CP laws weren't intended to apply to this situation.

I agree with you. Sexting violates the letter of the child pornography law, but not the spirit of it. The prosecution of teens for sexting did seem like an overreach.

So now we're going to punish teens for simply being teens? How about this, if parents don't want their kids "sexting", then take away their cell phones. Cell phones are a luxury for teens, NOT necessities, therefore parents need to intervene and do what it takes to stop the actions. Do we really need the government telling us what our kids can or cant do with their cell phones???? No I didn't think so!

Sexting could include sending sexually explicit pictures to one another which is considered child pornography.
