Texas Measure Could Affect Parents Of Teens Caught Sexting - MyStateLine.com

Quote:
(Austin, TX) -- Texas Attorney General Greg Abbott and Senator Kirk Watson filed Senate Bill 407 yesterday, and if made law, the bill would make sexting a misdemeanor for first-time offenders younger than 18-years-old. If convicted, the minor and a parent would be forced to complete a program about sexting's harmful consequences.
'Sexting' bill would bring in parents | KXAN.com

Quote:
Senate Bill 407 would classify a sexting offense as a Class C misdemeanor for first-time violators younger than 18 - a charge they say is a better fit for prosecuting teens. <snip> The new law would also allow teens to apply to the court to have the sexting offense expunged from their records.

First of all, it is already a more serious crime -- called child pornography.

This is actually a lesser offense that would allow for students and parents not to go to jail for possession of child pornography.

However, I'm not sure it is constitutional to require the parents to do anything when it is the child's crime.

While it is a violation of the CP laws I doubt many DA's would go after teens for sexting. I know there were stories in the news about a DA prosecuting a few teens and there was a fair amount of backlash.

IMO, the CP laws weren't intended to apply to this situation.

I agree with you. Sexting violates the letter of the child pornography law, but not the spirit of it. The prosecution of teens for sexting did seem like an overreach.

Doesn't the Legislature have anything better to do with it's time?

So now we're going to punish teens for simply being teens? How about this, if parents don't want their kids "sexting", then take away their cell phones. Cell phones are a luxury for teens, NOT necessities, therefore parents need to intervene and do what it takes to stop the actions. Do we really need the government telling us what our kids can or cant do with their cell phones???? No I didn't think so!

Social networking and helicopter parenting has changed that in the last ~5 years. If a teen doesn't have a cell phone s/he might as well be Amish.

Agreed. They can't be bothered to come up with a reasonable budget but they can find the time to propose laws which would make it illegal for teenagers to send dirty text messages to each other? Give me a break... And what does that have to do with child pornography laws?

Sexting could include sending sexually explicit pictures to one another which is considered child pornography.
