In my experiences the airline usually does not make the passenger pay the baggage fee if there is no more space in the overhead bins
and the bag was the correct size for the airlines carry on policy. They will gate check it and put on a little tag. For example on American they put a tag that says "Valet Luggage AA" and they write your name on it. The Valet Luggage is the last stuff put in the cargo hold, write at the door. When you get off the plane you wait inside the jet bridge right as you exit the plane and a ramp employee will come up and hand you the bag. However, some airlines will just send gate check luggage right on to the bagge claim. The policy does indeed vary from airline to airline.
Now, if you have a bag that is to big and you are trying to sneak it on and it won't fit, yep they will make you pay.
Here is a picture of a "Gate Check" ramp. The airline ramp employee puts the luggage with a gate check tag on the belt and it goes up to the jet bridge where you can collect it. Gate check luggage is not taken to the baggage claim area at the airport with the rest of the luggage.
