HI this is for NY unemployment, my question is I had one claim in 2008, I did 46 weeks.
Then I was was put on my second claim which I did not get me the whole 99 weeks because the unemployment rate dropped. I was only given 13 weeks.
Then they put me back on 2008 claim. I have 17 more weeks of that left. My question is after the weeks left on 2008 claim, if I do not find work. do they put me back on the 2009 claim for the seven weeks I have left on 20 weeks (emergency) because now NY state has extended the weeks again. because it is over 8 percent. thank you for your help

The 13 weeks for the 2009 claim were your new state benefits and have NOTHING to do with unemployment rate or Extended Benefits. You NEVER collected Extended Benefits on your 2009 claim. Therefore, NY resumption of High EB has NOTHING do with your situation at this time.

EB benefits are paid LAST, AFTER exhaustion of state and tier benefits under a new claim. At this point, you have only received 2009 state benefits and would need to exhaust 2009 tier benefits (if any) before becoming eligible for 2009 EB.

Since the 2009 claim paid only 13 weeks state benefits, it may not qualify for any EUC or EB benefits.

If by chance it does qualify, yes, when you have exhausted your 2008 claim tiers, NY will put you back on what remains of your 2009 claim, paying the tier benefits first - if the unemployment legislation is still in effect at that time.

Call NY to determine exactly what benefits remain on your 2009 claim, if any.

What I was trying to say 26 weeks of regular UI 20 weeks of EUC-Tier 1 13 weeks of EUC-Tier 2 14 weeks of EUC (13 weeks Tier 3 and 1 week Tier 2) 20 weeks of EB 93 weeks total
This is my 2009 claim I was on eb they only gave me 13 weeks because ue rate went down, they they switch me back to 2008 claim which I have 16 more weeks, I know I dont get the eb on my first claim. the question I wanted to know is when I am done with 2008 claim in 16 weeks, will I be entitled to the remaining 7 weeks on my eb claim on 2009, I am sorry if I repeat myself its just a bit confusing, if you explain it to me again I would really apreciate it. thank you for your time

Yes, provided
  1. NY's 3-month average unemployment rate is still at least 8% at the time you have exhausted 2008 benefits, and
  2. Congress extends the unemployment legislation.
