Please report what your Tier 3 exhaust date was, and also tell us what your Tier 4 allotment was.

This will be valuable information in other states that trigger off EB over the next two months. It appears that EB triggers off on Sunday, and because of the "entitlement" wording no one is really positive if still exists on the Saturday the day prior to triggering off, or if it's the Saturday 6 days out from triggering off that is the determining factor.

With 10 weeks at stake, it just might be worth skipping a claim filing so that you exhaust at the correct time between now and May 26 if there's any warning to when your state triggers off EB.

I emailed Oregon, and this appears to be their position:

From the above, we can infer that if you had even $1 or more in your tier 3 bucket for week ending 4/7/12, and when you file your claim for weekending 5/26 you fully exhaust, you're going to get 16 weeks of tier 4.

Extended Benefits:

Program changes as a result of data released March 13, 2012.
Kansas, Kentucky, Massachusetts, Missouri, Ohio, Oregon, South Carolina, Tennessee, and Wisconsin conclude an EB period.
The end of the payable period for these states in the EB program is the week ending April 7, 2012.

There ya' go. EB period ends 4/7, but Tier III cannot be exhausted before 4/14 if one wants to qualify for 16 weeks Tier IV. In other words, Tier III has to be exhausted at least one week AFTER the state triggers off EB (and not later than 5/26).

So, guy from BLS was wrong, as we suspected.

I attempted to contact KY and SC, but KY has no email facility on their webpage that I saw, and after typing in the near identical message that I used for OR, the form dumped the text that I'd typed and presented me with a second captcha (as in I needed to start over), so I didn't redo it a second time.

I think we can assume worst-case scenario all the states will use this approach. If by chance some states, don't - that's on them.

In states whose EB periods (as determined under EUCA) will end before June 1, 2012, beginning the first week AFTER the EB period ends, all individuals with new EUC08 Fourth Tier entitlement could qualify for the increased maximum benefit amounts.

So how does this translate to CA? That if CA triggers off on 5/12, only those who exhaust their tier 3 after 5/19 can qualify for the 16 weeks?

Thanks again. So confused.....

Not after, but on 5/19 earliest in CA. Only those exhausting Tier III with weeks ending 5/19 or 5/26 can qualify for 16 weeks in CA, assuming CA triggers off EB on 5/12, as projected. I would not gamble that CA will be any different than OR.

Best to structure your Tier III exhaustion for one week after CA is projected to trigger off EB, as we have been discussing all day.

I agree. I am of opinion that 5/19 is the final exhaust date if you have any control over it, and I think Ariadne22 agrees. There is just too many extra words in the interpretations with the new triggers, that the 5/26 date "might get it," but why take the chance?

In my case though, I just have to cross my fingers because I can't make my benefits exhaust any faster than 5/26, so I don't have a choice about "managing" my benefits advantageously.

Oregon takes this stuff seriously

Unemployment Insurance (UI) Unemployment Benefit Extensions

After yesterday's email exchange, their website is updated to reflect the 16 weeks for claimants. I give them an A+ for effort.
