So as the title states i was let go for attendance issues. Is there any chance i can get unemployment? The story behind this is that after 8 months of working no issues, they even told me i was a great worker and had nothing but positives from all supervisors, just my attendance got in the way. but anyways after 8 months i got injured on the job, after this is when i started missing quite a few days because of my injury, i told my employer this but they said there is nothing they can do about that. Also they told me that after i get my situation settled that i can go reapply in 2-3 months and they will rehire me. So should i try and see what happens?
Yes, you should try. Documentation from your doctor will make your case. If not with the deputy, then file an appeal and submit the documentation to an ALJ at a hearing.
Yes try. Sometimes an "attendance issue" that violates a company policy is not one that finds you ineligible for UI. For example, if they allowed you to miss 10 days, whether excused or not, and you missed 11, but had Dr's notes for all of them and were fired, UI MAY find that you violated the company's policy but not the UI policy. UI is basically set up with the idea that employers can set any standards they want and as long as an employee was doing their best to meet them, they should be eligible. This is an oversimplification, but it is also true.
I see a bigger issue in UI wanting to know if you are "able and available" as if you were missing work for an injury it may tell UI that you are not able to work, which will disqualify you.
