I got laid off from a job Nov 16, went to jail for 30 days dui. December 10 to Jan 9th. Got out of jail got my unemployment approved on January 20th. that's when my hearing was. I took a job for a day that wasn't suitable. I wasn't on unemployment I received 1200 in benefits from above 16 to dec 10th. after I got a proved I went to file for the next week and it was a week previous where I worked 1 day. I reported it. They said its pending because I worked and a new hearing for Feb 17 was schedule. Here is the letter I got in the mail.

You are disqualified from benefits from 1/18/15 to 2/1/15

you refused work on 01/18/15

you worked from 1/19/15 to 1/20/15

because your employment was for a brief period your separation is determined to be a refusal of suitable work rather than a voluntary quit. you have refused suitable work and have not shown good cause for the refusal. you are disqualified from benefits.

Am I suspended from benefits for that period and can keep filing after my disqualification period which has ended. Do I have to refile a claim? Am I denied benefits completely? Any help would be great. I spoke with a lawyer who said they have it as a refusal of work which carries a disqualification period. That I could re continue my benefit after I reopen a claim. just want to get some more options. Or should I appeal it? or just take the disqualification period then resume my ue payments. thanks

You dodged a bullet if you get benefits back. Normally, working 1 day and not going back would be a quit and you'd have to prove good cause, or live without the benefits.

I don't know how NJ does it, but I think you should "reopen" your claim, and if you filed from 2/1/15 until now, you should try to get your retro pay and file from here on out and see what happens.

If the job was truly unsuitable, you can certainly appeal, but under the circumstances, I think you should just try to get your benefits started back up and consider yourself lucky. In most any other state, you wouldn't have this opportunity.

Yes. NJ will need you to call them. I don't think they allow claims under dq periods, but am not sure.

No, the claim is alrleady in place for one year. Call to reopen if NJ won't allow you to claim the dq'd weeks.

You can collect at the end of your dq period AND file an appeal request now. Interviewer clearly did not listen to your reasons as to why the job was unsuitable and knee-jerk denied. Takes NJ a couple of months to hear appeals. Appeal if you want, or not. If you have good cause, you might get those two weeks' benefits paid retro. Otherwise you collect them going forward. Your monetary award is not reduced by the dq'd weeks.
