My husband lost his job 3/14. That same night, he filed for unemployment through delaware because that is where we live and his company also has an office here. Long story short is the company is based out of NJ also that is where he needs to file. Done. Non monetary phone interview scheduled for 4/9. Has been filing weekly claims regardless. I read on a thread in this forum that there is a way to possibly speed things along if there is a way to prove financial hardship. My husband is our only income and we cannot be without any kind of income for 8 weeks (yes, he is actively seeking employment in the meantime). We have in writing from his employer that they will not fight his UI so if need be, we can use that. My question is- how do we go about trying to prove financial hardship in the meantime? We have 2 kids under 3, a mortgage, etc. I very much appreciate any and all help that anyone may be able to offer!

Everyone uses the financial hardship to try and speed things up. Only when the process gets unduly long (not to be confused with timing due to normal processing) will anyone step in to speed things up. Unfortunately, the process has statutory time periods that nobody can jump over. If the law allows a certain time period for interested parties to respond, you will not get anything faster because the law won't allow anything faster.

As for fighting unemployment, employers don't have to fight anything to get you denied. It's the State that makes the determination if you are approved or denied for benefits based on the circumstances of the termination. All your employer can do is fail to respond forcing unemployed to use only what he told them about he termination. Hopefully he told them nothing damaging. However, an employer can truthfully respond and if that causes a denial, that is not them fighting anything; they just responded to a legal request for information from the State.

Complicating things is when you cross state lines. The "proper" way is for you to file in the state where the work was performed. If he worked in NJ, he files in NJ. If he worked in NJ and files in DE, expect a delay as DE will show no income at all and they may ultimately tell you to file in NJ. So, where did he work?

So did this guy. He ended up in appeals. He even came here first and didn't say one bad thing about himself and cause any problems. Therefore, you know the employer went back on their word.

That letter to "not fight," isn't worth anything in speeding up the process. If your husband got fired, you need to put your expenses on credit cards to ride it out or borrow money. If you are that broke, go get SNAP, lifeline, and any other social services to preserve your cash. Then remember for next time that you must always have money in reserve to wait on a UI decision.

He worked and lived in Delaware. However, because their main office is located in NJ, etc, Delaware told him that he had to file in NJ. I have no doubt that his employer will not say anything to jeopardize his UI benefits. As far as the application goes, all that he put on was that he was fired and that the reason is unknown because in reality, he was never given an actual explanation as to why he was fired. That being said, we’ve requested a written letter from HR that states his reason for termination and that request has been ignored.

He filed through delaware first. It was an employee of Delaware UI that sent him an email stating his weekly benefit amount and that he would need to file in NJ. We assumed that because he lives and works in Delaware, they would be the state to file through. We were wrong.

We have let it go. Haven’t had any communication with anyone for a week and a half. At this point, we are just trying to get them to mail him COBRA information as we need to have insurance coverage for our children, at the very least.

Do you have any idea where I might be able to look? Ive never had to do this before. Do I just google Delaware state exchange? Im sorry for all the questions!

healthcare.gov is the first place to look. If it doesn't let you select a plan base on your income (it's your income right this second which I suspect is zero because your husband isn't working and the UI hasn't turned on) then it will reject you and forward your information to whomever in DE handles Medicaid. If that happens, you can speed up the process by finding out where to apply for Medicaid in DE, and submitting an application.

Now in DE it might not be Medicaid. In my state it's called AHCCCS and in CA it's called Medi-Cal. Hopefully, you know some hardcore, poor people because they'll know all this stuff. They live it every day of their lives. Newly poor (like what you're going through) have a tough time because no one teaches this stuff.
