Hi - I exhausted the full 6 weeks of PFL starting July 2018. Date I last worked is June 2018.

I understand one may receive up to 6 weeks of PFL benefits in a 12 month period. My last PFL payment was 6 weeks after July 2018, so around Sept 2018. I currently caregive for a relative.

1) Am I eligible for PFL again?
2) If YES, when's the earliest I can apply?
3) Which base period would be used?

1) Am I eligible for PFL again? As you said, you can receive up to 6 weeks PFL in a 12 month period. Since you filed your 1st claim in July 2018, 12 months would be over in July of this year. Thus, you'll be eligible to file a new 6 weeks in July (not certain if they count to the day or just go by month).

2) If YES, when's the earliest I can apply? Not sure. Call them.
3) Which base period would be used? For a claim filed in July 2019, it will be April 2018 to March 2019. Therefore, assuming you are still unemployed, the wages used to determine your PFL eligibility and benefit amount will be based on what you earned April-June 2018 since you didn't work after June 2018. (Also, not sure what date you left your job in June, but your base period wages/benefit amount could have been higher now if you had filed in June instead of July last year.)

Thank you. Any difference in base period used if I apply next month in August as opposed to July? Still April-June 2018?

There shouldn't be a difference in base period since your filing date is based on the quarter you file--so, any day you file July-Sept should count as the same quarter with the same base period. That said, there is something about having to file within a certain time period after the leave begins (41 days??) or you "may" lose benefits. Assuming this PFL claim is for the same person/ailment as last year, not sure how this will be counted since 41 days is long past. Suggest calling to confirm both the filing date leeway and if there's any "deadline" given your situation technically started in 2018, but you used up the 6 weeks and want to start a new 6 weeks.



If it's for a new person and/or ailment, then you definitely want to be wary of that 41 day deadline and have good cause for any delay.
