Eh well...it is what it is. My vehicles are registered, I'm registered to vote...just need to gain an Alaskan DL...and as of June 5th, 2009, I'll be official. Of course, being human, the extra funds will be nice...but that isn't the reason I reside here.

An Alaskan "resident" is defined by Alaska Statute 16.05.940(27) as:

Therefore, as soon as 365 days lapse while they are in Alaska they become Alaskan residents. Then they must stay in Alaska from Jan. through Dec. of the following year before they would qualify for a PFD. It is a minimum of a two year wait, assuming they originally arrived in Alaska on Jan. 1st. Typically longer, as it was in my case. I arrived in Alaska on May 4, 1991 and didn't get my first PFD check until Oct. 1994. I became an Alaskan resident on May 3, 1992, but then I had to wait for the next "entire qualifying year" before I could apply.
AS 16.05.940 falls under Fish and Game regulations and therefore apply only to F&G residency requirements. Unless PFD or Revenue statutes define state residency, AS 01.10.055 takes presidence, as it is under the General Provisions of the Alaska Statutes.

By registering your vehicles and registering to vote you are demonstrating your "intent" to establish residency in Alaska under AS 01.10.055, and as you correctly pointed out, a year from this past June you will be officially an Alaskan resident. Then your "entire qualifying year" would be from Jan. through Dec. of 2010. Which means you could apply for your first PFD in Jan. 2011.

I agree with your last statement 100%. Nobody I know moves to Alaska for the annual PFD checks. I have even forgotten to file before the end of March a few years. It is nice, but no big deal. I'm just grateful it isn't ALL going to the state government. Too much already is.

AS 01.10.055 is about demonstrating the intent to establish Alaskan residency, it doesn't define a resident. AS 16.05.940 defines the meaning of "resident."

Back when they first started, people moved up for exactly that reason. I recall a family of 13 who did that and high tailed it back to the -48 as soon as the checks came in.

Wouldn't they have spent more in the two years waiting for their PFD checks, than the total amount of the checks? Seems rather futile and silly to me.

Glitch - back to the verbage - no where does it state 24 months or two years - it does not state resident status as for F&G - it says to make alaska as your residence for the 12 months, calendar year. Is way different that stating you must be a resident - different meaning. Will let ya know in January what they sayand don't really give a rip either....just hate legal mumbo jumbo - but the way I read says just have to live here for a calendar year

It is implied under AS 01.10.055 (c):

(c) A person who establishes residency in the state remains a resident during an absence from the state....

I believe AS 16.05.940 applies only to F&G licensing. If you check AS 43.82.230 (3), it defines Alaska resident by citing receiving a PDF or qualifying for a resident F&G license. So this implies any time requirements for residency need to be linked or specifically stated.
