Default avoiding resale document fee

In an HOA with fewer than 50 units that is managed by a management company, may an individual homeowner provide the required resale documents directly to the prospective buyer, thus avoiding the high fee that the management company charges to provide these documents?

If there's a lender/title co involved I think they're going to insist on "true copies" of the docs, which means someone is paying the fee. That said, many hoas provide their docs in .pdf format on a burned cd, so getting clear/accurate copies isn't exactly brain surgery. It's certainly possible to transfer title without those docs, because that's how they do it on the courthouse steps.. (the buyer gets nothing). In the end, it's more about paying the fee than it is about getting the docs - it certainly doesn't cost $275 to burn a .pdf to a cd, and the CC&R's are usually recorded docs that anyone could look up online if they cared to. In fact, many HOA's post everything online anyway.

Every HOA has different rules. As much as it make my blood boil, I've seen an Ohio State flag flying in my neighborhood. Assuming you meant college.

If you mean have there been changes in laws affecting HOAs since this one was passed in 2012, I'm not sure, but I'll bet someone who knows will chime in.
