You're missing my point. The courts don't rule on popularity, but congress is entirely dependent on popularity to get re-elected. It's possible that the Repubs are going to their districts and finding out that people actually LIKE some of the provisions of "Obamacare". So if it's declared unconstitutional, they're cooking up plans to incorporate some of its provisions.

Kagan may have met with Obama, but I doubt the SC has met with anyone else, and I'm nearly certain they're not telling Boehner, et al how they are going to decide.
