And just WHO would you prefer running your HOA Tiny, someone with zero leadership capability? Keep in mind the "thin air rules" you speak of normally are laid out in the CCR's if people would bother to read them, other are ones that the board passes due to the authority given to them in certain areas by the CCR's, they are covered and discussed in board meetings which I bet you are just too busy to attend.

I take back what I said above, you probably are not and never have lived in a HOA based upon this stupid statement!

"The well being of the community" is a flimsy pretext that has been used to justify everything from the absurd to the heinous.

Its an issue that does not want for anecdotes on either side but ultimately, it just boils down to personality types. There's a very large segment of the population who believe that life is best lived with a rigid set of rules and a governing body of people telling them what to do. They actually prefer to live that way.

If a HOA says no green houses and someone moves in complaining that they can't paint their house green, that's their own damn problem. Where HOAs get abusive is when there is no 'color rule', someone paints their house green but they invoke some borderline illegal 'catch all' rule buried on page 33, Section 20 to tell them they can't.

When it comes to laws and the 'fair' application of the rules, there are three types of people. Lawyers, the aggrieved and the naive. The naive make up 90%. They don't understand what happens when rules are weaponized to serve the petty vendettas of the 'enforcers'.

All HOA Hell stories come from this vantage.

Actually there is another segment--the people who know the rules but simply think the rules don't (or shouldn't) apply to them, and then complain about it when the rules are enforced.

Correct.
You join a club, you agree to abide by the rules.
Otherwise,don't join the cllub.
We have a great HOA, all elected by us with our interests at heart.
Some rules may be a bit picky but none are a deal-breaker and together they create a vibrant,well-run and much-loved community.
I can take you to a place less than half a mile away with an HOA which struggles to attract decent volunteers to run it and the community is a tip.But hey, everyone gets to do their own thing.

I think we're all on the same page about them.

Another way to look at it would be a nudist community. If you buy a house in a nudist community, do you have a right to complain about nudity? Of course not. Nobody is disagreeing with the idea that HOAs are entitled to set whatever rules they please (within the bounds of the law) and anyone who agrees to buy there is obliged to follow the rules they signed up for.

Clear cut, simple enough, we all agree.

That is a complete aside from the point of abusive HOAs (that pervert and contort the 'rules' to harass homeowners; HOAs lose in court with astonishing regularity) or HOAs that change or implement rules after the fact. Simply writing it off to WELL YOU SHOULDA BEEN MORE INVOLVED is a cheap and stupid way to justify something that is often times inherently unfair.

HOAs are like dictatorships. When they're fair and benevolent, there is absolutely no better system but when they take a turn for the worse, there is nothing worse.

This has turned into the stupidest thread. The people who hate HOAs are not going to be happy until we all agree all HOAs are bad and anyone who bought in one is an idiot. No matter what justification is offered they only come back and say HOA BAD!!!

That's an awfully stupid characterization.

HOAs can be well run but they can devolve into an entity that wasn't how they were originally intended.
It's just about that simple.

I do think that people who prefer to live their lives 'heavily governed' are a very particular breed and there's an unfortunate number of them out there in the world today. These are the sorts of people who love things like HOAs and will usually be the ones who are most enthusiastic in running them. Its good that they tend to cloister themselves in ****ty little "HOA Managed" communities because it makes them less likely to infest the areas of people who hate people like that, but I do feel sorry for the naive types who move into those places and wind up running afoul of weaponized HOA bureaucracy.

No, look at the words you chose to describe people who live in an HOA. So we're an "unfortunate number" who chose to live in "a ****ty little HOA Managed community", but it's good we didn't "Infest" your area, but I'm so glad you feel "sorry for us naïve types".

It's like the clueless young couple who buys the condo in the 'up and coming' part of the city that's still incredibly dangerous.
Some people try to warn them but there's no reasoning with idealism and until they get their first mugging, they're blissfully naive.

Don't worry about what I think of you and since you've already signed the contract, enjoy your 'great location'... but when the bad scenario happens and you find yourself realizing what a mistake you've made, don't let me find out about it because if I don't directly say "I told you so", you'll know why I'm smirking.

In the meantime, shouldn't you be out measuring your grass to make sure you're 'compliant'?
Hahaha, what hell and what a sad, sad people.
