The Empire State's chief executive has come under a lot of heat for issuing an executive order that changed the Department of Motor Vehicle policy that required license applicants to have a valid Social Security number. Now illegal immigrants will be able to obtain a license by providing a foreign passport and some secondary form of identification, such as a lease or a copy of parole papers.
Judicial Watch spokesman Chris Farrell says Spitzer wants to use his public office to sanction illegal behavior. "He's neglected to follow the laws of the State of New York, and he's elected to ignore the legislature," Farrell explains, adding that it is obvious to him the governor is unwilling to follow the normal course.

"He's attempting to rule by order, to change the rules -- and a governor can't do that. It's simply unlawful," says the Judicial Watch spokesman. "He is operating outside the scope of his authority. He needs to go through the legislature, draft up the law, have the legislators vote on it, and then sign it. [He needs to] follow the normal lawful process and not rule by gubernatorial fiat."
Farrell believes Spitzer is being motivated by politics. "He's decided that he needs to, in essence, pander to a particular group in order to gain their support or somehow influence the political process," he points out. "And he's demonstrated that he] is willing to go to extraordinary lengths -- but he's not willing to go to the legislature and have a regular vote on the matter."
