Does Nevada have felony murder laws? If so, that may be why the family is lying to protect the son from being charged with his mom's murder if he was involved in illegal activity.

I believe we do, if the Murder occurs during the commission of a crime.

I *believe* it's up to a grand jury to decide if the case can be prosecuted as felony murder?

One of the news reports I read, listed the charges as "murder with a deadly weapon". Is it possible to commit murder with a non-deadly weapon?

Not all weapons are deadly. What about the guy who was stabbed to death with a toothbrush, butter knife or broom handle?

The fact that the toothbrush, butter knife or broom handle killed the guy proves that those can be deadly. Just because their proper day to day use is not deadly doesn't make them non-deadly. Just like the proper day to day use of a gun, machete or car is not supposed to be deadly.

I just find the charge of "murder with a deadly weapon" to be a strange phraseology in Nevada law. If this little twit had attacked the TM with a toothbrush and killed her, would the charge be "murder with a non-deadly weapon"?

Exactly. That is why most (if not all other) jurisdictions will just charge the little a-hole with "Murder" and without a qualifier of "with a deadly weapon". I mean really, a pillow is not a deadly weapon but if I smoother someone with one for a few minutes, they are going to die.

Along similar lines, I have seen many preople on COPS arrested for "resisting arrest"... Umm, what? I was arrested for nothing other then resisting arrest? I think something is missing here.

That is a little easier to explain. Anytime a cop takes away your freedom of movement, you are technically "under arrest". Even a traffic stop for running a stop sign is technically an arrest and therefore, should you choose to resist the officers actions you are "resisting arrest".

But shouldn't the initial reason for arrest be stated and your refusal to comply be an additional charge of resiting arrest?
