Yes & no.
If the landlord doesn't want a fence, it really doesn't matter whether the association's rules allow it or not.
The landlord likely knows the rules.
Your legal relationship is with the landlord.
Check with the landlord first. You only need to bother with the association if the landlord says "Sure it's ok with me so long as the association approves it."

I agree that the landlord definitely has a say. But I'd go to the HOA first. I see that as a bigger hurdle but as you say, the actual owner should know the limitations of the property. As most won't even allow a flag, a permanent fence should be a real challenge.
