What'll probably happen is, you'll have plenty of parents supporting the program, since they all think that "their little angel" couldn't possibly be on drugs- especially in a high $$ town like Millburn. Once Little Johnny gets tossed out of school because they find dope in his system, that's when the lawsuits will start flying because Little Johnny's life has been destroyed by his inability to finish high school.
I don't think you get expelled for being under the influence or in possession of drugs in school. Maybe for repeated drug dealing or repeated offenses....
Honestly, after thinking about it a little bit, if it were my kids going to that school I'd be THRILLED to have drug sniffing dogs. There'd be no excuse for drug use or possession at school which is a very good thing. It seems draconian, but it's an end to a means.
I keep hearing about drug dealing in the high school in my town and I would love it if it were handled definitively like this.
When I was in middle and high school (and my high school was in an area much like Millburn), police would check our lockers, and dogs would come through and sniff our bags/items.
It's a good idea. The more they can do to put a dent in the drug game, the better.
Regarding rights and lawsuits, I always say that there is an inverse relationship between people's focus on their rights and their focus on their responsibilities. The idiot parents who scream, kick, yell and hit speed dial to get their attorney on the phone (because Billy's rights are being infringed upon) are likely the same parents who are grandmaster finger-pointers, and refuse to acknowledge any responsibility for keeping Billy off of drugs in the first place.

me thinks this is absolutely spot on.
