Where in the constitution does it say the government is allowed to dictate
the terms of your contract for someone to occupy that property?
The preamble to the Constitution states that one of the principal purposes of government was to "promote the common welfare."
And who ELSE but the government will establish all the rules of Contract Law?
So there you have it.
The Supreme Court visited the legality of Rent Control only last year, SPECIFICALLY in New York, and declined to hear the challenge to the law, leaving it stand as written. http://www.nytimes.com/2012/04/24/us...enge.html?_r=0
Couple of owners were pyssed that their tenants were paying less than a $1000 for spacious Central Park West apartments.
It's not a matter for the courts but rather for the electorate.
And I suppose you thought it was a good idea when the electorate believed slaves were a great idea. You know, so things can be easier and we have a better quality of life?
Good idea or not, we live in a so-called democracy where laws are made and must be adhered to.
When the electorate decided slavery was inhuman, the electorate voted with a super- SUPER majority to change the Constitution. What a minority in white hoods wanted was ignored. The same goes for what the landlords of New York want.
The electorate, the Constitution, and the Supreme Court all give rent control the thumbs up...just like all three give slavery the thumbs down.
They only declined to hear the case , no judgement was made. The supreme court will pick it up when a more interesting plaintiff comes around
I agree. Price control goes against everything the constitution stands for. I say, if people want cheap rent, have the city or government build their own housing and the people that want cheap rent can move there. Oh wait, that's called the Projects. And we all know how desirable the Projects are. Lol.

The Supreme Court will eventually strike this down
There's nothing more un-American than price controls
Constitutionally the government has the right to regulate business, and they do, big time.
Phone and utility service is made cheaper in rural areas by charging people in urban areas more, to offset the high costs and low profits of operating in rural areas.
