It's not about how WE would handle it. It's about how NY's justice system handles it now. We cannot change punishments because the victim fits the approved agenda demographic. That's not how a justice system is supposed to work.
I think this is a bit overstated. However she may end up with several low level criminal convictions. That may be more of an issue than the publicity, which will be forgotten in six months.

This is also a problem, Mom and kid being partners in crimes. That's just not a healthy relationship. Her mom probably ****ed her up mentally in raising her and now she is the way she is.
