Sorry if already covered but am curious if any of you have received photo radar tickets yet it was not you driving but someone else who borrowed your car!?!?! Am guessing it just comes to me having to rat out who I loaned my car to or suffer the consequences myself unjustly?

Yes, it has been covered at length. I'd send the ticket back, ratting out some "distant cousin" that lives in Peru (or something like that). Maybe a "friend" or relative that lives out of state. They won't pursue someone out of state.
Or, you could ignore it and make sure you don't answer your door for a while.
Or, you could rat out who ever it was, and let them deal with it.
There are several options. Just be sure not to pay it yourself.

I do believe there are instructions on the ticket if it is not you driving. You just send it back with a copy of your driver's license to show them the photo is not you and they will dispose of the ticket. The part of the ticket where it wants you to identify the person in the photo if you know them is not mandatory. It's up to you whether you want to fill this part out or not.

FYI, although this has been covered, if you show up in person, - and deny it's you driving, the judge will likely force you to disclose the driver, even though those cases have been repeatedly thrown out on appeal, because you don't legally have to disclose who the driver was.

Or you can just pay the ticket... the government here could really use the money... somewhere...

If the person was ticketed by a live DPS officer while driving your car, they'd have a ticket already, and would have to handle it themselves. If the person was driving their own car, they'd have a ticket and it would be their responsibility.

Whether you object to photo enforcement is irrelevant. Let the driver object to photo enforcement using whatever means they choose. If they object to you forwarding their information to DPS, maybe you should reconsider loaning your car to irresponsible people.

Understood. The devil is always in the details. The reprehensible awful person in this case was my wife. I guess we'll just end up paying darn thing. However, I'd like for her to request some type of deferred ajudication where if she pays the fine and doesn't get another one for however long, it simply drops off. Anyone heard of this? It should cost about the same as defensive driving without the awful wasted saturday in traffic school. I can't believe this stuff works. Don't you have a right to not testify against relatives or something to that effect? This has all gotten so crazy, I read about someone that came up here for a superbowl game and got 2 photo tix on the way home and someone in Tucson actually served him.

You don't have to pay it, and you're unlikely to ever be served. They only have 90 days from the date of the infraction to serve you, and the clock's tickin'.

That's why the state is turning the cameras off on the 101 - 60%+ of the tickets were never paid.

If you feel "bad" for not paying, you can donate $200 to the charity of your choice and make your wife say 10 "hail mary's".

At least that won't get your car insurance jacked.

It happened to me.

You are not a police officer, detective, etc. It is not your job to find out who was driving.

Write them a letter and tell them that the person behind the wheel is not you.

Our ticket was handled by our lawyer. There are lawyers who will handle this sort of thing for about 150.00.

I don't know what kind of ticket you received in the mail so I don't know how expensive the ticket is.

I'd ask the person who was driving to pitch in for the lawyer if need be.

In the end, it's better to maintain a clean driving record so your auto insurance will not go up.
