Now if Anwar al-Awlaki would care to surrender to U.S. or Yemeni authorities even as a declared unlawful combatant he would be afforded some of the rights afforded by the Constitution.

Of course if you gave him his full rights as a citizen you would undoubtedly screaming up and down about protesting Awlaki being confirmed any rights under the constitution.
So why won't Yemen capture him? Why is that? Why can't we go get him? If he gets killed in a firefight so be it.

Surprise, surprise.

The same right to use deadly force that we give the most raw police academy graduate (and even civilians in cases of self defense) is available to our federal government.

Who'd have ever imagined such a thing?

What do you mean "deemed legal"?

Are you saying that just because Bush received legal memos from lawyers saying that his torture of prisoners was legal that protects him from prosecution???

I'm sorry but Hitler had lawyers too and their advice to him didn't serve as a defense.

One has nothing to do with the other.

This isn't about killings on the battlefield or in self defense. Nobody disputes that. It's about putting an American citizen on a list to be killed while sleeping, while driving, while speaking on the phone.

Police are not allowed to that and neither is the President.

American citizens have something call "due process" and the US Constitution that protects them from tyrants.
