For the hardcore constitutionalists, do you think civil rights should be decided at the state level instead of the federal civil rights act?

For example, should we completely repeal the civil rights act of 1964 and if some southern states want to roll their states back to jim crow, then they should be allowed to? And if you live in the south and are black, move out or accept jim crow?

The wording in your poll is a little biased no? It purports to give only two options, federal regulation or Jim Crow. When in reality, in the absence of federal regulation there would be no Jim Crow. On the other hand, the court system wouldn't be plagued with frivilous discrimination cases, because it would not longer be legal.


You could reword your question to be "Should the federal government or the state governments be in control over whether or not there is forced seggegation?"

You might even try "Which do you trust more to protect your freedoms, the federal government or your state government?"

How about, "Do you believe in the centralization of all moral legislation into a single federal entity?"

Another good one.. "Do you believe that the federal government is infalible, and that the states are nothing but corruption?"


My question would be more stated, "Do you think the Civil Rights act, which gives special-privileges to minorities(even illegal-immigrants), and has created a nation of victims reliant on the Government, and invites nonstop discrimination lawsuits, and reduces productivity and civic involvement, has been a success?"

OR

"Do you believe that the Civil Rights act is unnecessary and bogs down the justice system, while putting an unnecessary burden on business, and that any regulation of social morality should be left up to the states, which are closer to the situation and better able to create policy that works in their particular case, rather than a one-size-fits-all system that has proven to be a failure?"

Quite a curious claim as Jim Crow laws requiring segregation flourished in the absence of federal regulation from the 1870's to the 1960's.

And that's all over the country, not just one section.

The moment it becomes a state issue, the Klu Klux Klan will come out of nowhere on horseback with shotguns going door-to-door, rounding up black families.

Then they will bus these families out to rural areas, chain them and force them to work in fields sun up to sun down.

This will all happen because:

1. Its not 2011, its actually 1913.

2. Blacks have no financial or political power here in 1913.

3. The Tsunami of brutal, white racism is kept in check only by the Federal bureaucracy in Washington, D.C. Once unleashed, this intense hatred of blacks will wash over our nation like a horde of venomous snakes.

4. White Americans certainly have nothing else to do. They just sit around all day planning a way to defeat the security wall of Federal Civil Rights Legislation.

BTW, nice unbiased poll you have there.

No it should not be a States rights issue. The bill of rights which as you know are ammendments to the FEDERAL constitution apply to every single American no matter what state they happen to be from.

We've been there and done that.

Civil rights based on states rights has been a complete and utter failure.

The Constitution confers and protects rights of ALL CITIZENS!

End of Story!

You're an idiot. Name for me a Southern state that would voluntarily roll back to Jim Crow. I love how your morally superior assumptions limit racism to states south of the Mason-Dixon. Proves your race-baiting.

I say now, yes.

The civil rights bill was a necessary evil for the time. Much like Roosevelts abuse of federal power for war time efforts, sometimes laws that aren't constitutional need to be passed and enforced for a given amount of time.

But when most people around the country are no longer in favor of Jim Crow, and when even in states like Mississippi African Americans exercise their right to vote, I feel we no longer need federal protection for this.
